Terms and Conditions of Stay

By completing a reservation at BamBam Bungalows – whether through Booking.com, any other platform, or a direct booking – and not cancelling upon receipt of the pre-arrival confirmation, the guest confirms having reviewed the published listing, photographs, amenities, and these Terms in full, and that the property meets their expectations accordingly. Proceeding with the reservation constitutes a binding agreement between the guest and BamBam Bungalows. Where a booking is made through Booking.com or any other third-party platform, that platform acts as a facilitator only and is not a contractual party to the guest’s stay.

These Terms are made available to guests before payment is taken and form part of the booking contract for every reservation, whether made directly or through a third-party platform. For reservations made directly through BamBam Bungalows’ own booking channels, the guest must expressly acknowledge acceptance of these Terms – by ticking the acceptance box presented during the booking process – before the reservation can be confirmed.

These Terms are published in English. It is the guest’s sole responsibility to ensure they have understood the contents, including by obtaining a translation where necessary.

BamBam Bungalows is a registered tropical coastal property in Nungwi village, Zanzibar, operated in accordance with the Zanzibar Tourism Act No. 6 of 2009 (as amended by Act No. 7 of 2012), the Zanzibar Tourism Regulations 2014, and other applicable local regulations. The following conditions are inherent to the property and its location, are fully disclosed as part of the property description, and do not constitute defects. No refund or compensation will be entertained on their basis.

1.1 Climate 

Zanzibar has a tropical climate with year-round heat, humidity, and periodic rainfall. These are permanent features of the location. Guests are encouraged to consider climate suitability before booking.

1.2 Ambient Noise 

Please read carefully before booking. Noise is the most frequently raised concern at this property.

BamBam Bungalows is situated within an active residential village. The following are permanent features of the surrounding environment and are entirely beyond Management’s control:

  • The call to prayer (adhan) from nearby mosques – five times daily, including before sunrise
  • Roosters, dogs, cats, and other animals common to village life
  • Music or gatherings at neighbouring properties
  • Construction activity in the surrounding area
  • General road and village traffic noise

Nungwi is a living community. Guests who require a controlled acoustic environment are respectfully encouraged to consider whether this property is the right fit. No refund or compensation will be granted on the basis of ambient neighbourhood noise.

1.3 Electricity, Generator, and Power Supply 

Electricity is supplied by the Zanzibar national grid. Power interruptions occur periodically and are beyond Management’s control. BamBam Bungalows operates a backup generator covering:

  • Hot water 
  • Refrigeration 
  • Fans 
  • Lighting 
  • WiFi and internet 
  • Charging points for small electronic devices 

Air conditioning is not supported by the generator. During a grid outage, air conditioning will be unavailable regardless of whether the generator is running. This is a fixed technical limitation and does not constitute a failure of service.

The generator runs on fuel. While BamBam Bungalows maintains fuel reserves, island-wide shortages occur periodically and may affect generator availability. Management will make all reasonable efforts to maintain supply but cannot guarantee uninterrupted operation during a shortage event.

No refund or rate reduction will be issued on the basis of power interruption or air conditioning unavailability, save where required by applicable mandatory consumer protection law. 

1.4 Hot Water 

Hot water is available throughout the property. Supply may be reduced during periods of high demand or utility disruption. Generator backup maintains hot water availability as described in clause 1.3, subject to fuel availability.

1.5 Wildlife and Resident Animals 

Insects, geckos, and other small fauna are naturally present indoors and outdoors at all times. Their presence does not indicate a lapse in hygiene or maintenance.

Dogs and cats are permanent residents of the property. They move freely throughout the compound and are part of the character of BamBam Bungalows. Resident animals are not permitted inside guest rooms. Should any animal enter a room, guests are asked to notify maintenance promptly.

BamBam Bungalows maintains its coconut palms and natural vegetation through regular care. Notwithstanding this, nature cannot be fully controlled. Falling coconuts and other natural occurrences remain an inherent feature of a tropical coastal environment. BamBam Bungalows excludes all liability for injury or damage arising from falling coconuts or contact with any animal or insect, save in cases of gross negligence or wilful misconduct by Management or its staff (see clause 6A).

1.6 Property Layout 

The property comprises fully enclosed indoor spaces, semi-outdoor areas, and fully outdoor spaces. Not all areas are air-conditioned or enclosed. The layout is clearly depicted in the listing photographs, which guests are deemed to have reviewed before booking.

Wet surfaces – including bathrooms, outdoor pathways, and poolside areas – may be slippery, particularly after rain. Guests are responsible for their own safety in all indoor, semi-outdoor, and outdoor areas and are advised to exercise appropriate caution at all times.

Stairs and uneven surfaces are present in parts of the property. Guests with mobility requirements should confirm suitability with Management before booking.

1.7 Beach and Marine Conditions 

The beach is subject to natural tidal variation. Width, water depth, and swimming conditions change with the tides and season. Seaweed may be present on the beach and in the water during certain periods. This is a natural oceanic condition outside Management’s control. Swimming, snorkelling, and all water activities are undertaken entirely at the guest’s own risk. BamBam Bungalows accepts no liability for beach or water conditions, save in cases of gross negligence or wilful misconduct by Management or its staff (see clause 6A).

1.8 Location, Roads, and Access 

BamBam Bungalows is located in Nungwi village. Distances to town, restaurants, and attractions are as stated in the listing. Road conditions, village traffic, and access routes in Zanzibar are variable and are in no way the responsibility of Management. Inconvenience arising from road conditions, construction, or local traffic does not give rise to any claim against the property.

Guests are responsible for arranging their own transport unless otherwise confirmed in writing by Management.

BamBam Bungalows may recommend, facilitate, or arrange bookings with third-party providers including water sports operators, tour guides, transfer services, and excursion companies. BamBam Bungalows may collect payments on behalf of such providers at its discretion, acting solely as a facilitator.

All such arrangements are made with the guest’s knowledge of the nature and quality of the relevant provider. By proceeding, the guest acknowledges awareness of what is being booked.

BamBam Bungalows is not a party to any arrangement between the guest and a third-party provider and accepts no liability for injury, loss, delay, disappointment, or any other mishap arising from third-party services, regardless of whether payment was collected by BamBam Bungalows on the provider’s behalf, save where BamBam Bungalows has itself acted with gross negligence in selecting or recommending the relevant provider.

Guests are advised to verify the credentials of any third-party provider and to obtain appropriate travel insurance covering third-party activities.

Guests agree to indemnify BamBam Bungalows against any claim, loss, cost, or liability arising from the guest’s use of, or participation in, any third-party service, tour, or excursion arranged or facilitated under this clause, save to the extent that such claim, loss, cost, or liability arises from BamBam Bungalows’ own gross negligence in selecting or recommending the relevant provider.

BamBam Bungalows fulfils its disclosure obligations through the published listing, photographs, pre-arrival communications, and these Terms, in accordance with applicable Zanzibar consumer protection law and applicable Zanzibar tourism regulations. Refunds will not be granted in respect of any matter that:

  • was disclosed in the listing, photographs, or amenities section prior to booking;
  • is described in the pre-arrival message or these Terms;
  • constitutes a natural or environmental feature of the property or its location; or
  • was not reported to Management within the timeframe set out in clause 4.

In any dispute – including those initiated through Booking.com or any other platform – BamBam Bungalows will rely on the published listing, pre-arrival correspondence, and these Terms as evidence of prior disclosure.

Nothing in this clause excludes or limits any refund or remedy to which a guest is entitled under applicable Zanzibar consumer protection law.

Any concern regarding the room, facilities, or service must be reported to Management in person or in writing within twelve (12) hours of check-in.

This allows Management the opportunity to inspect and resolve the matter during the stay.

Concerns raised after this window, or for the first time following check-out, will not be accepted as grounds for refund or compensation.

Where a guest can demonstrate that a concern could not reasonably have been reported within this window – for example, because the issue only became apparent later, or because of circumstances beyond the guest’s control – Management will consider the concern on its merits.

Before initiating any refund request, platform dispute, or external complaint, guests are required to:

  • Notify Management of the issue in writing;
  • Allow a minimum of twenty-four (24) hours for a response; and
  • Accept any reasonable remedy offered, such as a room change, repair, or service adjustment.

Guests who escalate to a platform or third party without completing this process waive their entitlement to compensation, save where doing so would deprive the guest of a right that cannot lawfully be waived under applicable consumer protection law. Evidence of this process will be submitted in any dispute proceeding.

Subject to clause 6A, BamBam Bungalows shall not be liable for inconvenience or disruption arising from circumstances beyond its reasonable control, including:

  • Weather, heat, humidity, or rainfall;
  • Insects, geckos, birds, resident dogs and cats, or other wildlife;
  • Falling coconuts or other natural occurrences, notwithstanding regular maintenance of trees and vegetation;
  • Ambient noise, including mosque calls to prayer, music, construction, animals, or road and village traffic;
  • National grid power interruptions or island-wide fuel shortages affecting generator operation;
  • Internet and WiFi outages caused by local infrastructure providers;
  • Beach seaweed, tidal variation, or ocean conditions;
  • Road, access, or village conditions;
  • Actions by government authorities or third-party providers.

This exclusion is consistent with the limitations of operator liability recognised under the Zanzibar Tourism Act No. 6 of 2009 and general principles of Zanzibari contract law.

Save as expressly provided otherwise in these Terms, BamBam Bungalows excludes all liability for the matters described in these Terms to the fullest extent permitted by applicable law. Nothing in these Terms excludes or limits liability for:

  • (a)  death or personal injury caused by the gross negligence or wilful misconduct of Management or its staff;
  • (b)  fraud or fraudulent misrepresentation; or
  • (c)  any liability which cannot lawfully be excluded or limited under the Zanzibar Contract Decree (Cap. 149), the Zanzibar Tourism Act No. 6 of 2009, or applicable Tanzanian consumer protection law.

For the purposes of these Terms, “gross negligence” means a serious and obvious failure by Management or its staff to exercise the degree of care that a reasonably competent operator would exercise in the same circumstances, going beyond ordinary negligence or oversight.

Subject to the above, BamBam Bungalows’ total liability to a guest arising out of or in connection with a stay, however caused, shall not exceed the total amount paid by the guest for that stay.

BamBam Bungalows will take reasonable care to maintain the property’s walkways, communal areas, and shared facilities in a reasonably safe condition, having regard to the property’s tropical coastal setting.

Subject to clause 6A, guests assume sole responsibility for their own safety and that of their party throughout their stay. BamBam Bungalows accepts no liability for injury or illness occurring in any area of the property – whether indoor, semi-outdoor, or outdoor – including but not limited to:

  • Slipping on wet or uneven surfaces;
  • Falling coconuts or contact with animals or insects;
  • Accidents in any area of the property or grounds;
  • Injury or illness arising from swimming or water activities.

Guests are advised to wear appropriate footwear and observe sensible precautions throughout their stay.

8.1 Charges Due on Arrival – Cash Only 

The following are not included in the booking platform rate and are payable in cash on arrival:

  • Tourist Tax: USD 2.00 per person, per night
  • Air conditioning: USD 5.00 per unit, per day (where applicable)
  • Any outstanding room balance

8.2 Accepted Currencies 

USD · EUR · TZS. Exchange rates for EUR and TZS are applied at the prevailing rate on the date of payment.

8.3 Card Payments 

Subject to a 5% processing surcharge. Cash payment is recommended to avoid this charge.

8.4 Transfer Service 

USD 50.00 per journey (one way), confirmed in writing in advance. BamBam Bungalows accepts no liability for delays caused by third-party transport operators.

8.5 Taxes and Charges

All rates quoted are inclusive of applicable service charges unless stated otherwise. Government taxes and levies (including the Tourist Tax referred to in clause 8.1) are payable in addition to the room rate and are subject to change in accordance with Zanzibar law. Any change in the rate of a government tax between the date of booking and the date of stay will be passed on to the guest at cost.

  • Free cancellation: 14 or more days before arrival – full refund.
  • Under 14 days before arrival: non-refundable.
  • No-show: full reservation value forfeited; room may be released after 24 hours.

All cancellations must be submitted in writing, either directly to Management or through the booking platform on which the reservation was made. Verbal cancellations are not accepted.

For the purposes of this clause, a “Force Majeure Event” means any circumstance beyond Management’s reasonable control that could not have been avoided through reasonable precautions, including but not limited to natural disasters, extreme weather events, government orders or travel restrictions, civil unrest, epidemic or pandemic, mandatory evacuation orders, or failure of essential public infrastructure (power, water, or transport) beyond the property’s control.

Force majeure – pre-arrival: In the event of a Force Majeure Event rendering the property unavailable or a reservation unable to proceed, BamBam Bungalows reserves the right to cancel the affected reservation. Any refund in such circumstances will be assessed at Management’s reasonable discretion, having regard to the circumstances and any refund obligation that may apply under mandatory Zanzibar consumer protection law.

Force majeure – mid-stay: Where a stay is interrupted or cut short due to a Force Majeure Event, BamBam Bungalows shall not be liable for any loss, inconvenience, or additional cost incurred by the guest as a result. Any partial refund for nights not spent at the property in such circumstances will be assessed at Management’s reasonable discretion, having regard to the circumstances and any refund obligation that may apply under mandatory Zanzibar consumer protection law. Guests are strongly advised to hold comprehensive travel insurance covering trip interruption and curtailment.

10.1 Timings 

Check-in from 14:00 | Check-out by 11:00.

Early check-in / late check-out: USD 25.00, subject to availability, confirmed in writing.

10.2 Identification 

Valid government-issued photo ID is required from all guests at check-in. Management will retain a copy or photograph of the identification document presented. Check-in will not be completed without this step.

Identification documents are collected and retained solely for the purposes of guest registration and compliance with applicable Zanzibar tourism and immigration requirements, and are handled in accordance with clause 20 (Personal Data).

10.3 Room Allocation and Type Availability 

BamBam Bungalows operates a small-scale property with a limited number of room types. While every effort is made to honour the room type selected at the time of booking, room allocation remains subject to availability at the time of check-in and throughout the stay.

The reservation of a specific room type does not constitute a guarantee of that exact room. Factors including but not limited to maintenance requirements, prior occupancy, unforeseen circumstances, or operational necessity may result in the allocation of an alternative room of equivalent or superior standard.

Guests may not demand a specific room, unit, or floor on the basis of a prior booking, photograph, or verbal representation. Where an alternative room of equivalent standard is available and offered, no refund, discount, or compensation will be due.

Where BamBam Bungalows is genuinely unable to provide any room of the type booked and no reasonable alternative is available, the guest’s sole remedy shall be a refund of the affected night(s) at the rate paid. This clause does not affect the guest’s rights under applicable Zanzibar consumer protection legislation.

10.4 Room Condition on Departure 

Guests are expected to leave the room in a reasonable condition at check-out. This includes ensuring windows and doors are closed and locked, air conditioning and fans are switched off, and all property-issued items – including towels, linen, and keys – remain in the room. Removal of any property item, however minor, will be treated as damage and invoiced accordingly under clause 15.

An additional cleaning charge may be levied where the room is left in a condition requiring cleaning beyond normal turnover standards. Management will notify the guest of any such charge within 24 hours of check-out.

Breakfast is included in the room rate for all registered guests. Service is available daily between 08:00 and 10:00 at the designated breakfast area.

Guests who require breakfast outside these hours – whether earlier or later – are asked to notify Management in advance, no later than the evening prior. BamBam Bungalows will make every reasonable effort to accommodate such requests, but early or late service cannot be guaranteed and is subject to staff availability.

Breakfast is not transferable to outside guests unless included in the applicable day pass or overnight guest rate as set out in clause 12. No refund or credit will be issued for breakfast not consumed.

Guests are expected to respect the property, its staff, and fellow guests at all times.

  • Quiet hours: 22:00 to 08:00.
  • Smoking is not permitted inside rooms or in any area where other guests may feel disturbed. Smoking is permitted in outdoor areas of the compound away from other guests.
  • Illegal substances are strictly prohibited. Discovery will result in immediate termination of stay without refund and notification of the police.
  • Pets are not permitted without prior written authorisation from Management.

Where a guest’s conduct warrants refusal of entry or removal from the property, Management will act in accordance with the procedure set out in clause 19.

Visitors and Outside Guests 

  • Overnight visitors not included in the original reservation must be announced in advance, approved by Management in writing, and present a valid government-issued ID upon arrival, which Management will copy or photograph.
  • Outside guests are not permitted inside rooms under any circumstances.
  • Outside guests are welcome at the pool, for breakfast, and on the roof terrace.
  • Day pass: USD 20.00 per person.
  • Additional overnight guests: USD 30.00 per person, per night, inclusive of breakfast.

The pool is available for use by registered guests and authorised outside guests daily between 06:00 and 22:00. Use outside these hours is not permitted. Pool closure at 22:00 is aligned with the property’s quiet hours as set out in clause 12.

Between 06:00 and 08:00, guests are asked to keep noise to a minimum in consideration of other guests and neighbouring residents. This includes limiting music, loud conversation, and splashing.

The pool is unsupervised at all times. There is no lifeguard on duty. All swimming and use of the pool area is entirely at the guest’s own risk. Subject to clause 6A, BamBam Bungalows accepts no liability for injury, illness, or drowning occurring in or around the pool.

In the event of an emergency at or near the pool, guests should immediately alert any available member of staff and, where necessary, contact local emergency services. Emergency contact information is displayed at the property and provided to guests at check-in.

Children under the age of 6 are not permitted in or around the pool. Children aged 6 and above must be accompanied and actively supervised by a parent or guardian at all times while in or near the pool. Staff are not responsible for the supervision of children under any circumstances.

The following are prohibited in and around the pool:

  • Running or rough play on poolside surfaces
  • Glass containers of any kind
  • Food in the pool
  • Unsupervised children

Guests are reminded that poolside surfaces may be wet and slippery. Appropriate footwear is recommended when moving between the pool and other areas of the property.

BamBam Bungalows welcomes families with children aged 6 and above, subject to the conditions set out in this clause.

Children under the age of 6 are not permitted to stay at the property. This restriction applies regardless of the room type booked and is a firm condition of acceptance. Reservations made without disclosure of a child under 6 may be refused at check-in without refund.

This age restriction reflects the property’s layout and safety features – including an unsupervised swimming pool, direct beach access, and the absence of dedicated child-safety infrastructure – and is applied consistently to all guests as a safety measure rather than as a matter of preference.

Children aged 6 and above are accepted provided they are able to swim. Parents and guardians confirm at the time of booking that any child in their party meets this requirement. BamBam Bungalows does not independently verify swimming ability and accepts no liability arising from a guest’s failure to accurately represent this.

Parents and guardians are solely responsible for the safety, conduct, and supervision of children in their party at all times and in all areas of the property, including the pool, beach, outdoor walkways, and communal areas. Staff are not responsible for child supervision under any circumstances.

Children are subject to all applicable house rules, including quiet hours, pool rules, and conduct standards. Where a child’s behaviour causes disruption to other guests or damage to the property, the accompanying adult bears full responsibility.

Guests are financially responsible for any damage caused to the property, its fixtures, furnishings, or equipment during their stay. Management will assess and invoice repair or replacement costs accordingly.

Wilful damage will result in immediate termination of stay without refund.

Where damage is identified, Management will provide the guest with a description of the damage and a reasonable estimate or invoice of the associated repair or replacement cost, generally within 48 hours of the damage being identified. On request, Management will provide reasonable supporting documentation, such as photographs or a repair quotation.

15.1 Keys and Access Devices 

Room keys and access devices are issued to guests at check-in and must be returned at check-out. The following charges apply:

  • Lost key or access device: USD 100.00 per item
  • Damaged or broken lock resulting from misuse: USD 100.00 or the actual cost of repair or replacement, whichever is greater

These charges are payable in full before departure. Where departure occurs before the matter is identified, BamBam Bungalows reserves the right to pursue recovery of the amount owed.

15.2 Valuables and In-Room Safe  

An in-room safe is provided for the storage of cash, documents, and valuables. Guests are strongly advised to use it throughout their stay.

BamBam Bungalows accepts no liability for the loss or theft of cash, jewellery, electronic devices, travel documents, or any other valuables left unattended in the room, in communal areas, or elsewhere on the property, whether or not the room was locked at the time.

Pursuant to applicable Zanzibar law governing the liability of accommodation providers, Management’s liability for loss of or damage to guests’ personal belongings is limited. Guests are advised to obtain comprehensive travel insurance covering theft and loss of personal property prior to travel.

Guests may take personal photographs and video recordings for private use within the property. The following restrictions apply to all guests and their visitors:

  • Filming or photographing other guests, staff, or third parties present at the property without their prior express consent is strictly prohibited.
  • Filming or photographing the property, its interiors, staff, or other guests for the purpose of public posting, publication, or commercial use requires the prior written consent of Management.
  • Publishing, sharing, or distributing any content – photographs, video, audio, or written material – that includes identifiable images of staff, other guests, or private areas of the property without the prior written consent of Management and the individuals concerned is not permitted.

Nothing in this clause restricts a guest’s ability to post genuine reviews, opinions, or personal photographs of their own stay that do not include identifiable images of other guests or staff without consent.

Breach of any provision of this clause constitutes a material breach of these Terms. The guest accepts personal liability for the actual, reasonably foreseeable losses and costs directly arising from the breach, including reasonable legal costs – including the costs of content removal, takedown proceedings, and any compensation payable to affected individuals – arising directly or indirectly from such breach. This liability survives check-out.

Where content published in breach of this clause includes identifiable images of staff or other guests, the affected individual(s) may have independent rights of action against the guest under the Personal Data Protection Act (Tanzania), which prohibits the collection, processing, and publication of personal data – including photographs – without the consent of the data subject. BamBam Bungalows reserves the right to provide the affected individual(s) with the guest’s contact and booking details for the purpose of pursuing such a claim.

Management reserves the right to demand immediate removal of any content published in breach of this clause. Failure to comply within 24 hours of written notice constitutes a further and continuing breach, and Management reserves the right to pursue all available legal remedies including injunctive relief.

Breach of this clause may also result in immediate termination of stay under clause 19 without refund.

For the safety and security of guests, staff, and property, BamBam Bungalows operates closed-circuit television (CCTV) cameras in designated public and common areas of the property, including entrances, the reception area, car park, pool surroundings, and outdoor walkways.

CCTV monitoring is limited strictly to public and common areas. No camera is installed, and none will be installed, inside guest rooms, bathrooms, changing areas, or any other private or semi-private space.

Footage is used solely for the purpose of guest and staff safety, crime prevention, and incident investigation, and is not used for any other purpose. Access to footage is restricted to authorised personnel and is retained only for as long as reasonably necessary for these purposes, in accordance with the Personal Data Protection Act (Tanzania).

Notices indicating the presence of CCTV are displayed at the property. By staying at BamBam Bungalows, guests acknowledge and accept the use of CCTV in public and common areas as described in this clause.

Further detail on how CCTV footage and other personal data are collected, used, stored, and retained is set out in BamBam Bungalows’ Privacy Policy, available on request and displayed at the property.

BamBam Bungalows is a small guesthouse situated in a coastal village environment. It is not equipped with medical facilities, and no medical or first-aid personnel are stationed on the property. The nearest hospital and emergency services are located at a distance, and response times in the event of a medical emergency cannot be guaranteed.

Guests with pre-existing medical conditions, mobility limitations, allergies, or any other health considerations are responsible for assessing the suitability of the property before booking.

Subject to clause 6A, BamBam Bungalows accepts no liability for injury, illness, or deterioration of a pre-existing condition occurring during a stay.

In the event of a medical emergency on the property, staff will make reasonable efforts to assist – including contacting local emergency services and providing basic first aid where trained to do so – but are not medically qualified and cannot be relied upon to provide medical treatment or diagnosis. BamBam Bungalows is not liable for any delay in the arrival of emergency services or for any outcome arising from a medical event, save in cases of gross negligence or wilful misconduct by Management or its staff (see clause 6A). Guests are strongly advised to carry appropriate medication, travel health insurance, and emergency contact information at all times.

BamBam Bungalows takes reasonable care to ensure that rates displayed on its direct booking channels and third-party platforms are accurate. However, technical errors, platform synchronisation delays, or other factors may occasionally result in an incorrect rate being displayed or confirmed.

This clause applies only to rates that are manifestly and obviously erroneous – for example, as a result of a missing digit, misplaced decimal point, or technical fault – and does not apply to legitimate promotional, discounted, last-minute, or otherwise reduced rates offered by BamBam Bungalows or a booking platform in the ordinary course of business.

Where a booking has been confirmed at a rate that is materially incorrect due to a system or platform error, BamBam Bungalows reserves the right to contact the guest prior to arrival and offer either the correct rate or a full refund of any amount paid. Proceeding with a stay following notification of a pricing error constitutes acceptance of the corrected rate.

BamBam Bungalows is not bound by rates that are clearly erroneous, including rates that are manifestly below market value as a result of a technical fault.

Management reserves the right to refuse admission or terminate a stay, without refund, where a guest:

  • Breaches any provision of these Terms;
  • Engages in threatening, aggressive, or abusive conduct toward staff, other guests, or any person on the property;
  • Causes wilful damage to the property;
  • Fails to settle charges due on arrival; or
  • Has provided materially false information at the time of booking or check-in.

Save in cases involving an immediate risk to safety, illegal activity, or serious misconduct, Management will, where reasonably practicable, give the guest an opportunity to explain their conduct or to remedy the issue before terminating a stay under this clause.

In serious cases – including but not limited to possession of illegal substances, conduct endangering the safety of others, or commission of a criminal act – Management reserves the right to notify the relevant authorities, including the police. No refund will be issued following termination for cause.

Guest personal data – including name, nationality, and identification documents – is collected for reservation fulfilment, guest registration, and compliance with applicable Zanzibar tourism legislation and the Personal Data Protection Act (Tanzania). Identification documents will be copied or photographed at check-in as required by law. Data is retained for a minimum of three years in accordance with regulatory requirements and will not be disclosed to third parties except where required by law.

Management will take reasonable technical and organisational measures to protect guest personal data, including CCTV footage as described in clause 16A, against unauthorised access, loss, or disclosure.

Where applicable, guests may request access to, correction of, or further information about the personal data BamBam Bungalows holds about them by contacting Management using the details provided at the property. BamBam Bungalows will respond to such requests within a reasonable time and in accordance with applicable data protection law.

These Terms are governed by the laws of Zanzibar and, where applicable, the United Republic of Tanzania, including:

  • Zanzibar Contract Decree (Cap. 149)
  • Zanzibar Tourism Act No. 6 of 2009 (as amended by Act No. 7 of 2012) and the Zanzibar Tourism Regulations 2014
  • Fair Competition Act (Cap. 285), to the extent applicable to consumer protection matters
  • Personal Data Protection Act, 2022 (Tanzania), to the extent applicable to Zanzibar as a Union matter

These Terms are written in English. English is the governing language of these Terms and of any dispute arising from them. Where a translation exists or has been provided for convenience, the English text prevails in all cases.

Where a reservation was made through Booking.com, guests note that the contract governing their stay is directly with BamBam Bungalows. Booking.com acts as a booking facilitator only and is not a party to these Terms. Booking.com’s own General Delivery Terms govern the relationship between the guest and the platform and are separately governed by Dutch law with disputes subject to the courts of Amsterdam. Those terms do not affect or override these Terms.

Where a guest initiates a dispute through Booking.com or any third-party platform, BamBam Bungalows reserves the right to present these Terms, the published listing, and all pre-arrival correspondence as evidence. Any dispute arising from a stay at BamBam Bungalows shall be subject to the non-exclusive jurisdiction of the courts of Zanzibar.

Management reserves the right to amend these Terms at any time. The version in force at the time of check-in governs the relevant stay. Updated Terms will be published on the booking page and reflected in pre-arrival communications.

Amendments to these Terms apply prospectively only, to bookings made after the amended Terms are published, and do not affect the Terms applicable to an existing confirmed reservation.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force, and the invalid provision shall be replaced with one that most closely reflects its original intent within the bounds of the law.

Guests are responsible for checking their room and personal belongings before departure. BamBam Bungalows accepts no liability for items left behind after check-out.

Where an item is found after a guest’s departure, Management will make reasonable efforts to contact the guest and arrange return of the item at the guest’s request and expense. BamBam Bungalows is not obliged to store found items indefinitely. Items unclaimed after thirty (30) days of being found may, at Management’s discretion, be donated, disposed of, or otherwise dealt with without further notice to the guest.

BamBam Bungalows reserves the right to cancel or refuse to honour any reservation reasonably believed to involve fraud, including but not limited to bookings made using a stolen or unauthorised payment method, false identity, or materially false booking information.

Where a reservation is cancelled under this clause, BamBam Bungalows will make reasonable efforts to notify the guest and, where appropriate, the relevant booking platform. BamBam Bungalows reserves the right to report suspected fraudulent activity to the relevant booking platform, payment provider, or law enforcement authorities.

Before initiating a chargeback or payment dispute with a card issuer or payment provider, guests are required to first raise the matter with Management in accordance with clause 5 (Right to Remedy Before Escalation).

Where a guest initiates a chargeback that is later found to be unwarranted – for example, because the disputed service was in fact provided and the guest had accepted these Terms – BamBam Bungalows reserves the right to contest the chargeback by providing evidence of the booking, acceptance of these Terms, and the service provided, and to pursue recovery of any amount owed together with reasonable costs associated with contesting an unwarranted chargeback.

Rates are quoted and confirmed in the currency shown at the time of booking. Where payment is made in a currency other than that in which the rate was quoted, the applicable exchange rate is that prevailing on the date of payment, as set out in clause 8.2.

BamBam Bungalows accepts no liability for any change in exchange rates between the date a reservation is made and the date of payment or stay. Guests who wish to avoid exchange rate exposure are advised to pay in the currency in which the rate was originally quoted, where accepted.

Save where a longer period is required by mandatory Zanzibar or Tanzanian law, any claim by a guest arising out of or in connection with a stay at BamBam Bungalows must be notified to Management in writing within six (6) months of the last day of the stay to which the claim relates. Claims notified after this period may be treated as time-barred, without prejudice to any statutory limitation period that cannot lawfully be shortened by agreement.

In these Terms, unless the context otherwise requires: headings are for convenience only and do not affect interpretation; words importing the singular include the plural and vice versa; “Management” refers to BamBam Bungalows and its owners, operators, and staff, as the context requires; “writing” and “written” include email and other electronic communication; and references to a statute include that statute as amended, re-enacted, or replaced from time to time.

By proceeding with this reservation, the guest confirms that they have reviewed the listing, photographs, amenities, and these Terms in full; that they understand and accept all conditions described, including those relating to noise, wildlife, climate, utilities, property layout, room allocation, breakfast arrangements, pool use, children policy, keys, valuables, photography restrictions, CCTV monitoring, health and medical limitations, force majeure, lost property, reservation fraud and chargebacks, and currency fluctuation; that the property meets their expectations based on the published information; and that they accept personal responsibility for their safety and that of their party – including any children in their care – throughout the stay.

These Terms constitute a binding agreement between the guest and BamBam Bungalows.
